Position Description :
Position is a property and liability claims adjuster role and adjusts high exposure, politically sensitive claims and lawsuits (such as bad faith, medical malpractice, highway design, care custody and control, employment, auto liability, personal injury, fatalities, and serious physical injury, constitutional rights violations, large property losses, etc.) filed against the state, as well as pursuing subrogation recoveries due the state.
The adjuster position performs work of extreme complexity that requires the ability to investigate, analyze, evaluate property damage, serious injury compensation, life care plans, and wrongful death claims, prepare file summary reports and litigation reports to management, submit authority requests to negotiate and settle losses, submit applicable notices for loss prevention review, and to prepare the claim file for litigation and work in conjunction with the Attorney General's Office to resolve lawsuits in the best interest of the State. The position settles claims/lawsuits within the independent authority extended, and/or makes recommendations for settlement and obtains authority to resolve claims and lawsuits.
MAJOR RESPONSIBILITIES AND % OF TIME FOR EACH
30% - Analyze investigative materials to determine liability and settlement values . Document and obtain physical evidence to support the facts and related damages.
25% - Determine coverage and conduct factual investigations . Includes conducting interviews and securing recorded statements from witnesses, law enforcement, agency personnel, and reviewing all other releva nt materials associated with the incident, etc.
15% - Research and apply applicable tort, contract, and other relevant areas of law or case law. Prepare claims for litigations.
10% - Document and obtain physical evidence to support the f acts and related damages . Work in conjunction with the AG's Office during discovery to obtain additional investigative information and prepare for depositions, etc.
10% - Prepare cost benefit analysis to determine action to be taken in the best interest of the State. Secure the procurement of independent appraisers/adjusters, experts and consultants (engineers, architects, cause and origin, life care planners, structured settlement brokers, and jury research and focus groups, etc). Obtain authority and negotiate settlements. Prepare necessary closing documents to protect the state from future exposure.
10% - Other duties as assigned.
